Terms of Service

1. Agreement
These Terms of Service ("Terms") govern access to and use of the CIMA platform and website at cima.ai (the "Service"), operated by CIMA ("CIMA," "we," "us"). By accessing or using the Service, you agree to these Terms on behalf of yourself and, where applicable, the business you represent. If you do not agree, do not use the Service.
2. The Service
CIMA is an AI-powered marketing platform for mortgage companies. The Service includes advertising campaign management across connected platforms such as Meta and Google, marketing attribution and analytics reporting, synchronization with customer relationship management (CRM) systems, and hosting and management of business websites and landing pages. Features may change as the platform evolves.
3. Accounts and Responsibilities
- You must provide accurate information when creating an account and keep it current.
- You are responsible for safeguarding your credentials and for all activity under your account.
- You must have the authority to connect any third-party account (such as an ad account, page, or CRM) that you connect to the Service.
- You are responsible for the content of your advertising and websites, including compliance with mortgage advertising laws and regulations that apply to your business.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful, deceptive, or discriminatory purpose, including advertising practices prohibited by fair lending and fair housing laws.
- Attempt to gain unauthorized access to the Service, other customers' data, or underlying infrastructure.
- Interfere with or disrupt the integrity or performance of the Service.
- Resell, sublicense, or misrepresent the Service without our written consent.
5. Third-Party Platform Terms
The Service interoperates with third-party platforms, including Meta and Google. Your use of those connections is additionally governed by those platforms' own terms and policies, including the Meta Terms of Service, Meta Commercial Terms, and Advertising Standards, and the Google Terms of Service and Google Ads policies. You must comply with those terms, and you authorize CIMA to access and process data from those platforms on your behalf through the connections you create. CIMA is not responsible for the actions, availability, or policy decisions of third-party platforms.
6. Customer Data
As between you and CIMA, you own the data you or your connected systems provide to the Service. You grant CIMA a limited license to host, process, and transmit that data solely to provide and improve the Service for you. Our handling of personal information is described in the Privacy Policy.
7. Intellectual Property
The Service, including its software, design, and content provided by CIMA, is owned by CIMA or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to CIMA's trademarks, branding, or software except as needed to use the Service.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIMA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CIMA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ADVERTISING RESULTS WILL MEET ANY PARTICULAR PERFORMANCE TARGET.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIMA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM OR RELATED TO THE SERVICE. CIMA'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO CIMA FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
10. Indemnification
You agree to indemnify and hold CIMA harmless from claims arising out of your advertising content, your violation of these Terms, or your violation of applicable law or third-party platform policies.
11. Termination
You may stop using the Service and disconnect your integrations at any time. We may suspend or terminate access to the Service for violation of these Terms or where required to protect the Service or comply with law. Sections that by their nature should survive termination will survive.
12. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in California.
13. Changes to These Terms
We may update these Terms from time to time. The current version will always be available at cima.ai/terms. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
